Politics, hell if you talk about judges that's politics.
As old time politician once said a judge is a lawyer to lazy or incompetent to practice law and knows a politician.

I stand corrected about everything I've said in this thread. I cannot argue with a cat pushing a watermelon out of a lake -- it's unassailable and quite convincing. I give up. 

Now for more important matters -- does this cat of yours push any large fruit out of any body of water or just watermelons out of lakes? Pomegranate out of pond? ..... Grapefruit out of a river? I need to know!

If the DNA evidence would have been pertinent, it would have come up in the second or third trials -- but it did not.  Only at the last minute when he had lost on all the myriad other arguments why he should not be executed did Arthur bring up DNA.  Even if the DNA were matched to someone else, it would only prove that someone else was involved -- not that Arthur wasn't involved.

I presume you are not including ME in the latter category you mention, because I have made neither inhuman nor degrading comments in any of my postings here.  And, if you'll read my earlier posts (before I read the judge's opinion) you'll see that I, too, was unsure about this matter at first.

I think you're wrong in your interpretation of the facts, but that's perfectly acceptible.

While I believe many people made really great points on this topic, whether they stated a position or not, I believe it is time for us, as a group of adults, to lay this conversation to rest.  We are very close to relighting the powder keg which was the Europe and Gun Control arguments.  Nothing but hurt feelings and some people scheming came out of the days of arguing and back biting.  I believe everyone has made their points, lets move on.

I wish I could disagree with Srehtims on this point but in my 7 years practicing law I found this was true more often than not. I'd put it at about 75% of the Judges I dealt with were political hacks without a lot of common sense. The biggest problem was that (where I practiced at least) the judges were elected and their campaigns were fueled by a lot of contributions from their fellow lawyers (mostly on the defense side) and therefore they were a bit deferential to their former colleagues.

That having been said I did see some very good judges who were both former defense lawyers and former prosecutors. It really came down to a willingness to call the lawyers before them on BS when they were shoveling it.

I think the most important point I want to make out of this whole thing is that these types of situations (death penalty cases where the defendant is claiming innocence etc.) are often far more complicated than simple platitudes like "let him test the DNA that would exonerate him" -- the system can produce absurd results on occasion but most of the time the results are fair. It really comes down to don't rush to condemn the actions of others...
