While I don't like it, it is still covered by the rule.  We have to use the original release date.
No dictator, no invader can hold an imprisoned population by force of arms forever.
There is no greater power in the universe than the need for freedom.
Against this power, governments and tyrants and armies cannot stand.

At the very end of the post you asked "Would the production dates for both these films be the original years or the re release dates ??"...and I was just supplying that answer as it was covered in the rules so there is no question on how to handle it. As it is already covered in the rules.

Correct, Pete.  POints can be made for all kinds of answers on this issue. As I recall we had quite a discussion on this, I believe Star Wars was our model. I think the Rule was decided based on the fact that movies had not been fundamentally changed for the Special Editions, the performances of the actors had not been changed, it was still the same films that were released in 1978, but technology had allowed for the visuals to be improved, so it was decided to stay with the Original Production Year for such films that have been re-released. In these cases copyright dates are not indicative of very much, a copyright has to be renewed on a regular basis to retain ownership, I think it's 17 years, if it is not renewed then the film falls into the public domain (not a good place).

Perhaps a dump question, but if a movie is shown on a film festival and after that at theatres. What is in such case the theatrical release = production year?

So say for example a movie was shown at festivals in 2005 and then a DVD came out in 2008 I'm going to use 2008 as the production year? Doesn't sound right to me.
